PRODUCT RETURN/EXCHANGE- CLAIM OF DEFECT

If the Buyer (You) determine that product(s) shipped to you are defective, e-mail Extend Your Lashes Customer Service within seven (7) days of receipt (info @ ExtendYourlashes.com) or call 801-471-7378. You will be given a return authorization number (RA#).

The product must be returned to:

within seven (7) days after receiving your RA#, and enclosed with: 1) the RA# 2) explanation of claim of defect and 3) your request for exchange or refund. Extend Your Lashes, LLC reserves the right to either replace defective product or provide a refund of the purchase price upon receipt of defective product.

For hygienic and quality control reasons, Extend Your Lashes can NOT accept returns of any individual product, unless Extend Your Lashes shipped the wrong items, only then items can be exchanged. In the event that your shipment is damaged or incorrect, please contact us immediately for a resolution by calling 801-785-5274. Buyer agrees that all sales made through Extend Your Lashes, LLC are final. All products are not available on a "try and return" basis, so please shop wisely.

Unauthorized Returns Will Be Shipped Back To Sender

Due to the limited shelf life of the adhesive, only unopened/sealed packages returned within 10 days of receipt will be accepted for a refund of Buyers purchase price less a 25% restocking fee and shipping charges. Any missing, damaged or opened/unsealed items will be deducted from the total kit purchase price at full retail value. Returns must be shipped back at your cost and enclosed with 1) a written request with the purchasers information 2) a reason for the return and 3) a list of any items missing, damaged and/or opened/unsealed, or your request may not be processed. Return shipments must be addressed to: Extend Your Lashes, LLC. Attn: Customer Service, 9113 Hillside Drive, Cedar Hills, UT 84062. Once received, please allow for up to 14 days for the return to be processed and appropriately credited back to the original credit card.

REFUNDS ON TRAINING

Class cancellations or re-schedules with over seven (7) days written notice will receive a refund, less a $50 non-refundable administrative charge.

Absolutely no refunds on training fees will be provided after the scheduled training date for any reason.

NO GUARANTY OF CERTIFICATION/RIGHT TO DECERTIFY

For general public safety, and to protect the brand and reputation of all those who successfully comply with Extend Your Lashes safety standards and practices, Extend Your Lashes does not guarantee certification and maintains the right to de-certify individuals that the company perceives may cause harm to either individuals or the brand.

Attendance at Extend Your Lashes training does not guarantee certification. You must be able to demonstrate to a Certified Extend Your Lashes Instructor that you can perform the technique safely, or at our sole discretion you may be invited to attend additional training at no additional cost.

Extend Your Lashes, LLC in its sole discretion, reserves the right to decertify and prohibit Buyers use, or any of Buyers affiliates use of Extend Your Lashes products, brand, logo, marketing materials, marketing services, images, and all forms of training material for substandard applications of eyelash extensions or any practice that is perceived by Extend Your Lashes to be unsafe. Because of quality control and related issues, Extend Your Lashes LLC reserves the right to decertify anyone using non-Extend Your Lashes adhesives or other components not distributed by Extend Your Lashes LLC when applying Extend Your Lashes products for a client. 

ADDITIONAL BASIC TRAINING AT NO ADDITIONAL COST

If after taking the training, you either need, or prefer additional instruction, you are welcome to attend another scheduled training session at no additional cost. If you would like to schedule a review session, please notify our office as soon as possible to reserve your spot as space is limited.

MODEL REQUIREMENT FOR TRAINING CERTIFICATION

You are required to bring a model to the training, however if you are traveling from out of town and are unable to do so, please contact us as soon as possible and we will attempt to make arrangements for you. Please inform your model of the time they need to be present for the training.

FOR PROFESSIONAL USE ONLY

This product is not intended, nor should it be used for, self application of lash extensions. This product is to be applied only by individuals certified by Extend Your Lashes, LLC and in accordance with the laws of your state.

State licensing requirements for the application of lash extensions vary from state to state, so it is incumbent upon you to research the requirements for your state and comply with any laws and regulations concerning the application of any lash extension products. It is the policy of Extend Your Lashes, LLC to sell to licensed professionals in the beauty and medical industry. Whereas certain states do not require a license to practice certain beauty or body treatment disciplines (such as professional make-up artistry or permanent make-up artistry.

ACKNOWLEDGEMENT OF RISKS

You recognize that the procedure of applying eyelash extensions can never be 100% safe and that accidental injury to the eye or the premature falling of lashes may occur and that appropriate precautions must be taken to safeguard the well being of your client. You agree to use Extend Your Lashes, LLC products in a safe manner and to take all measures of precaution such as, but not limited to: 1) requiring that contact lenses be removed for any given part of the procedure; 2) completely covering the lower lashes to protect them from bonding to the upper lashes; 3) covering and protecting the upper eyelids so that they remain closed for the duration of the procedure; 4) thoroughly consulting with the client to identify contraindications and ensure the client is a good candidate for lash extensions; and 5) using the eye irrigation solution for each client post removal of lash extensions, and as necessary. As a condition of your purchase of Extend Your Lashes products, you acknowledge and accept the inherent risks associated with applying lash extensions and agree to comply with Extend Your Lashes safety standards.

CLIENT IN-TAKE FORM/CONSENT TO EYELASH PROCEDURE

As a condition of your purchase of Extend Your Lashes LLC products, you agree that you will not apply Extend Your Lashes products onto the eyelashes of any person without first having such person sign and date a standard Extend Your Lashes Client In-take Form entitled Client Sign In and Release of Liability, whereby the client is made aware of the risks of the procedure, consents to the procedure.

RIGHT TO DISCONTINUE, REFUSE SALE, AND SUBSTITUTE

Extend Your Lashes, LLC reserves the right to discontinue or refuse sales of our product to anyone and to discontinue or substitute any product contained in our kits or within our product line without prior notification. Extend Your Lashes, LLC in its sole discretion, reserves the right to prohibit Buyers use, or any of Buyers affiliates use of its products, brand, logo, marketing materials, marketing services, images, and all forms of training material and pursue all legal remedies as allowed by law. Extend Your Lashes; LLC reserves the right to takes such steps if any of the terms of this agreement are violated and for cause. Examples of causes that may persuade Extend Your Lashes, LLC to prohibit use of its products, brand, logo, marketing materials, images, and all forms of training material are, but not limited to:

1) Substandard applications of eyelash extensions and/or unprofessional behavior as determined

by company or repeated complaints by customers

2) Offering service at substandard prices for market area.

3) Revealing confidential, proprietary or copyrighted information to any other individual.

INDEMNIFICATION AND WAIVER OF LIABILITY

YOU AGREE TO DEFEND, HOLD HARMLESS AND INDEMNIFY EXTEND YOUR LASHES LLC, ITS OWNERS, OFFICERS, DIRECTORS, AGENTS, INDEPENDENT CONTRACTORS, EMPLOYEES, SUPPLIERS AND LICENSORS (EXTEND YOUR LASHES, EXTEND YOUR LASHES LLC ET AL ) AGAINST ALL COSTS, DEMANDS, LIABILITIES, EXPENSES AND LOSSES, (INCLUDING REASONABLE ATTORNEYS FEES AND COSTS) INCURRED THROUGH YOUR VIOLATION OF THESE TERMS OR INCURRED THROUGH ANY CLAIMS BY THIRD PARTIES AGAINST EXTEND YOUR LASHES LLC OR ANY OF ITS OFFICERS, DIRECTORS OR AGENTS BASED UPON YOUR USE OR APPLICATION OF EXTEND YOUR LASHES PRODUCTS ON ANY PERSON. YOU ALSO AGREE THAT ANY LIABILITY OF EXTEND YOUR LASHES LLC CONCERNING THESE PRODUCTS REGARDLESS OF THE THEORY UPON WHICH RELIEF MAY BE BASED (WHETHER CONTRACT, TORT OR OTHERWISE) SHALL BE LIMITED TO THE AMOUNT OF MONEY YOU HAVE PAID TO EXTEND YOUR LASHES LLC FOR THE SPECIFIC PRODUCT AT ISSUE AND THAT WITHOUT THIS RESTICTION, EXTEND YOUR LASHES LLC WOULD REFUSE TO SELL THESE PRODUCTS TO YOU. IN NO EVENT WILL EXTEND YOUR LASHES, LLC OR ITS DIRECTORS, OFFICERS, OWNERS, EMPLOYEES, INDEPENDENT CONTRACTORS, SUPPLIERS AND LICENSORS (EXTEND YOUR LASHES, LLC ET AL) BE LIABLE FOR ANY CLAIMS, DEMANDS, DAMAGES, LIABILITIES, SUITS, ATTACHMENTS, JUDGMENTS, LOSSES, PENALTIES, FINES, SETTLEMENTS, EXPENSES, INCLUDING COURT COSTS AND REASONABLE ATTORNEYS FEES INCIDENT THERETO; INDIRECT, SPECIAL, INCIDENTAL, ECONOMIC, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF THE USE OR MISUSE OF PRODUCTS OR SERVICES SOLD BY EXTEND YOUR LASHES, LLC. BUYER SHALL INDEMNIFY, DEFEND AND HOLD HARMLESS EXTEND YOUR LASHES, LLC ET AL FOR ALL SUCH CLAIMS AND ACTIONS IN EACH CASE NOTWITHSTANDING THE ACTUAL OR ALLEGED NEGLIGENCE (WHETHER ACTIVE OR PASSIVE, SOLE OR CONCURRENT, SIMPLE OR GROSS), STRICT OR STATUTORY, PROVIDED THAT THE EXTEND YOUR LASHES, LLC LIABILITY WILL BE LIMITED TO THE PURCHASE PRICE OF THE PRODUCT.
